NCL KIDS WORLD MEMBERSHIP

NCL Kids World Membership is a program administered by NCL Solutions Sdn. Bhd. (“the Company") and the purchase or use of its program at any time during the validity of its membership drive subjects the purchaser or the user benefits stated below subject to the terms and conditions herein stated.

For an individual to qualify as a Personal Member the individual must:-

be 18years and above or have the parent/guardian who is 18 years and above to sign the registration form if he/she is below age;
purchase books that are carried by the Company or which is available at the time concerned amounting to RM 50.00 (after discount) in one bill together with registration fee of RM 15.00; or
purchase books that are carried by the Company or which is available at the time concerned amounting to RM 100.00 (after discount) in one bill. Registration is FREE for first year in this situation.

For a company to qualify as a Corporate Member, the Company must have purchased books up to the amount of RM 1,000.00 (after discount) in one single bill or accumulatively until RM1,000 is reached before enjoying members benefit. The accumulation must be within one year from the time of the first purchase.

Membership Entitlements

PERSONAL MEMBERSHIP

During the duration of the validity of the Personal Membership the following benefits shall ensue:-

10% discount on the selection of books/titles carried by the Company (which may be varied by time to time depending on availability);
every Ringgit Malaysia spent equals 1 membership point. The accumulated points can be used to exchange for free books and gifts selection of which is determined by the Company (which may be varied from time to time). Points can be accumulated on a yearly basis up to 3 years (provided yearly membership has been renewed);
10% discount and 3% discount for purchase of other products and services respectively provided by the Company. These purchase/s must be purchased directly from the Company which for the time being includes:-

Surveillance System –Product;
Edu-Tourism -Services;
Edu-Excursion -Services;
Synergy E-learning content -Product;
Financial E-learning content -Product.

Personal Members are also entitled to the following additional benefits:-

Occasional free gifts as may determined by the Company from time to time depending on availability.
Subsidized educational trips;
20% discount on top of members discount (10%) for books only during purchases at road shows that the Company directly participates (which may varied from time to time)
Free participation for our Edu-Tourism/Excursion program when 10 to 14 successful participants have been personally introduced to the Company for programs conducted during the introductory period;
50 points for every reference for the Company's membership;
Occasional special buy products as may determined by the Company from time to time.

CORPORATE MEMBERSHIP

This category of membership is applicable to schools, tuition centers, libraries, educational institution and corporate or government departments. Corporate members are entitled to:-

20% discount on the selection of books/titles carried by the Company (which may be varied by time to time depending on availability);
1 membership point per ringgit spent on books and this can be accumulated and converted to free books and gifts of which is determined by the Company (which may be varied from time to time). Points can be accumulated on a yearly basis up to 3 years (provided yearly membership has been renewed);
10% and 3% discount for products and services respectively purchased directly from the company and this includes:-

Surveillance System- Product
Edu-Tourism - Services
Edu-Excursion - Services
Synergy E-learning content -Product
Financial E-learning content – Product

Additional Benefits

20% discount on top of the regular personal member’s discount(10%) at road show for BOOKS only (which may varied from time to time)
attend free seminars specially organized for members and conducted by the Company;
1 free participation for introduction of 10 to 14 participants for Edu-Tourism or Edu-Excursion that is being offered during the period;
100 points for every new member recruited;
special buy products as may determined by the Company from time to time.

MEMBERSHIP CONDITIONS

NCL Kids World Membership is available to all qualifying individuals..
We reserve the right to reject applicants for NCL Kids World Membership and this membership is revocable at any time without cause at our sole discretion (see Program Termination section below).
An individual or a corporation is only entitled to one NCL Kids World Membership.
For any discount or other benefit to apply, the NCL Kids World Membership account number must be active and available at the time of purchase. You will not be reimbursed retroactively for purchases made without a NCL Kids World Membership account.
NCL Kids World Membership benefits are only valid on eligible products/services/purchases from NCL Solutions Sdn. Bhd.
If multiple NCL Kids World Members refer the same person to the membership, we reserve the right to give the points to the NCL Kids World Member who first referred the person.
NCL Kids World Membership is non-transferable.
Membership points will be calculated end of the every month.
The Company expects all members to submit and maintain accurate user information in connection with their NCL Kids World Membership account. Such information includes name, address, e-mail address and telephone number. Members can change their account information by (i) calling the Company at 03-7956 8082, (ii) fax to us at 03-7958 7308 or (iii) contacting us via e-mail at nclclub@nclsolutions.com.
The Company cannot assume any liability for correspondence, mail, e-mail, which is lost, delayed or misdirected.

MEMBERSHIP RENEWAL

PERSONAL MEMBERSHIP

Free renewal with minimum 500 points accumulated within one year, or
RM15 renewal fee for less than 500 points accumulated within one year.

CORPORATE MEMBERSHIP

Free renewal with minimum 4000 points accumulated within one year, or
RM50 renewal fee for less than 4000 points accumulated within one year.

We may change the membership fee at any time, but changes will apply only to new and renewal memberships. The fee is not refundable.

Occasionally for special promotion items, members are not entitled for their standard discount.

TERM

The initial term of NCL Kids World Membership shall commence on the date it is obtained and continue until the end of the year on which the membership was obtained unless the Company terminates your NCL Kids World Membership.

NCL KIDS WORLD MEMBERSHIP CANCELLATION

You have the right to cancel your NCL Kids World Membership at any time. No refunds will be available and all points will be deleted (unless we terminate the NCL Kids World Membership Program; see Program Termination section below). You can cancel your NCL Kids World Membership by (i) calling us at 03-7956 8082, (ii) fax to us at 03-7958 7308 or (iii) contacting us via e-mail at nclclub@nclsolution.com.

PROGRAM TERMINATION

The Company may terminate any of the benefits available to you or all Members under the NCL Kids World Membership Program at any time with or without notice. In the event of the Company's termination of this program or your NCL Kids World Membership benefits until expiration of the Member's current membership term or refund each member a pro-rate portion of the membership fee for the remaining portion of your current NCL Kids World Membership term.

PRIVACY

For online member registration, the information the Company's capture will be subject to the nclsolutions.com. Privacy policy as amended from time to time in accordance with the terms. CLUB ACTIVITIES

Guardians/Parents and members who participate in all activities organized by NCL Kids World shall release and discharge NCL Kids World or the Company and their staff from all claims, responsibilities, liabilities arising from injuries, loss, death caused to or sustained by their child/children during the course of the activities. The participants are responsible for their own insurance coverage in respect of these matters.

Guardians of members who participate in all the activities organized by NCL Kids World shall release and discharge NCL Kids World or the Company and their staff from all claims, responsibilities, liabilities arising from injuries, loss, and death caused to or sustained by their child/ children during the course of the activities. The participants are responsible for their own insurance coverage in respect of these matters.

PRODUCTS & SERVICES DISCLAIMERS

Use or enrolment NCL Kids World Membership is at your sole risk. The NCL Kids World Membership benefits are provided on an "as is" and "as available" basis. The Company and any of its affiliates, directors, officers, staffs and agents (collectively called "the Provider") expressly disclaims all warranties of any kind, whether express or implied, including but not limited warranties of merchantability, fitness for a particular purpose and non-infringement. The Provider makes no warranty that (i) NCL Kids World Membership will meet your requirements, (ii) NCL Kids World membership will be uninterrupted, timely, secure or error-free, or (iii) the quality of any products, services, information, or other material purchased or obtained by you from your use of NCL Kids World membership will meet your expectations. The Provider shall not be liable for any direct, incidental, special consequential or exemplary damages including but not limited to damages for loss of profits, goodwill, use, date or other intangible losses (even if the Provider has been advised of the possibility of such damages) resulting from (a) the use or the inability to use NCL Kids World membership or any benefits thereof; (b) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transaction entered via the use of NCL Kids World membership; (c) unauthorized access to or alteration of your NCL Kids World membership data; or (d) any other matted relating to NCL Kids World membership.

CHANGES IN THE TERMS AND CONDITIONS

The Company may at any time and at its absolute discretion change any of the terms and conditions contained herein without giving any notification of such changes in writing to its members. NOTICES

All written notices referred to in this Agreement shall be deemed to be properly given and served on the party to whom such notice is to be given within three (3) days of sending by post.

GOVERNING LAW

This Agreement will be governed by the laws of Malaysia and the parties submit to the exclusive jurisdiction of the Malaysian court .

SEVERANCE

If any provision of this Agreement is held by a court of competent jurisdiction to be illegal, invalid or unenforceable that provision shall be severed and the remaining provision shall remain in full force and effect.

ENTIRE AGREEMENT

This Agreement (i) constitutes the entire agreement between the parties and (ii) supersedes all prior and contemporaneous agreements or communications with respect to its subject matter.

COSTS

In any suit or action to enforce any right or remedy under this Agreement or to interpret any provision of this Agreement, the prevailing party will be entitled to recover its costs including reasonable attorney's fees.

RESPONSIBILITIES CLAUSE

Every participant under this registration shall be deemed in all respect to carry his/her own risks. It is advisable that all participants are adequately insured for the full duration of the package in respect of illness, injury, death, loss of baggage and personal items, cancellations and curtailment when participating in active land and sea based activities.
